New Accounts

Prepayment or cash upon pickup is required for all new accounts. Please allow ten (10) business days for company check to clear before shipment. Your first four (4) orders must be paid in cash, certified bank check, cashier’s check, money order, wire transfer, or Zelle (furniture@bestqualityfamily.com). Thereafter, company checks may be accepted upon approval of credit and verification of creditworthiness. Your company name and address must appear on your check and match your account with Best Quality Furniture. Temporary, personal and postdated checks are not acceptable. We will charge a fee of $30.00 for each returned check and will no longer accept checks after a second returned check.

Inspection Period and Acceptance (Claims):

Claims for any defects or omissions in shipments must be made in email or phone call within 48 hours of your receipt of the goods. Failure to give Best Quality Furniture notice within the 48-hour period after receipt shall constitute an irrevocable acceptance of the goods delivered. Any installment shipment of goods that you retain for a period of 48 hours shall constitute an irrevocable acceptance of the goods contained in the installment. If you elect to reject any of the goods, you agree to notify us of such rejection within 48 hours of your receipt of the goods, and agree to return the goods to Best Quality Furniture in its original packaging and condition at your expense within 96 hours after such rejection, otherwise your acceptance of the goods shall be irrevocable and conclusively presumed. A restocking fee will be applied to goods rejected/returned for credit. $25.00 minimum charge or 20%, whichever is greater, excluding shipping fee. NO CASH REFUNDS, NO EXCEPTIONS. Company credit will be issued. Pictures are required to claim damage/defective merchandise with a copy of the invoice and RMA Form. Please note that unauthorized returns will not be accepted. NO EXCEPTIONS. We reserve the right to examine and inspect all defective or damaged goods before deciding to either issue credit, replace or repair the goods (at our option). All returned shipments must be freight prepaid. Any claims for merchandise damaged in transit must be made through the freight carrier. Best Quality Furniture is not liable for any shipping costs. Customer is liable for ALL SHIPPING FEES. All defective goods that are returned to Best Quality Furniture must be packed in the original boxes with original packaging materials without any writing on the box. Assembled and/or previously displayed goods will not be accepted for return, refund, credit or exchange. Best Quality Furniture will not accept or honor chargebacks, debits, returns, offsets, deductions, or claims without Best Quality Furniture’s written consent. We ask you to exercise common business courtesy and notify us of any issues so that we have the opportunity to address your concerns and amicably reach a solution. End users must contact the dealers for service. Best Quality Furniture is a wholesaler and does not deal with end users directly.

Freight

To reduce and prevent pick-up traffic, all freight companies should make an appointment 24 hours prior to arriving at our warehouse. All shipments are F.O.B. from our warehouse and or shipped Freight Collect. Oversized items, and items with glass, mirror or marble cannot be shipped via Parcel Service (i.e. UPS, FedEx, etc.).

Compliance & Warnings

Proposition 65 Warning: All products sold by Best Quality Furniture are subject to the requirements of California’s Proposition 65 (The Safe Drinking Water and Toxic Enforcement Act of 1986). By law, we are required to inform you that our products may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.

Pricing, Taxes, & Fees

  • Pallet Charges: Palletizing costs will be quoted separately and are not included in the base price of your furniture quotation.
  • Taxes: All applicable federal, state, and local sales, use, or excise taxes are your responsibility. These taxes are in addition to the prices listed in our quotations and invoices, unless we expressly state otherwise in writing. We reserve the right to invoice you for these taxes separately at a later date.
  • Tax Exemptions: If you are tax-exempt, you must provide a valid tax exemption certificate with your order, unless we already have one on file for you.

Pick-up & Abandonment

  • Customer Pick-Up: Unless we agree otherwise in writing, you must pick up your order from the Best Quality Furniture warehouse within three (3) business days after pickup appointment has been scheduled.
  • Failure to Pick Up (Abandonment): If you fail to pick up your goods within this 3-day period, the goods shall be considered abandoned. Best Quality Furniture may then dispose of the goods in any manner deemed necessary or proper. In the event of abandonment, you will not be entitled to any reimbursement or refund, and you remain fully liable for the original purchase price of the goods.

Limitation of Liability & Damages

  • Limit on Damages: Due to our highly competitive prices, your only right to recover damages shall be limited to the difference between the original contract price and the market price of the goods.
  • Exclusion of Other Damages: You explicitly agree that you cannot recover contingent, punitive, incidental, or consequential damages (such as lost profits or business interruption) of any kind from Best Quality Furniture.
  • Force Majeure (Uncontrollable Events): We will not be liable for any loss, damage, delay, or failure to perform any part of this agreement that is caused by events outside of Best Quality Furniture’s control that prevent or hinder the manufacture or delivery of your goods.

Governing Law & Disputes

  • Governing Law: The rights and obligations of both parties will be governed by the laws of the State of California.
  • Jurisdiction for Disputes: Any legal actions or disputes between you and Best Quality Furniture must be filed and resolved in the courts located in Riverside County, California.
  • International Sales Convention: The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to transactions with Best Quality Furniture.
